Man is Killed by Shredding Machine, Wife Sues Employer for $1 Million

On July 11 in Houston, TX a temporary worker/subcontractor went into his job at Consolidated Distributors and was working with a RecycleTech XT200 machine. This powerful machine is designed to take Styrofoam, shred it and melt down the material which is then stored away. The man was performing a duty that he was trained to do, but this time something went terribly wrong. Police report that the man was reaching into the RecycleTech XT200 machine when he was suddenly pulled inside it. The man suffered fatal injuries and the cause of death was deemed to be multiple blunt forces to the body.

The man’s employer, Consolidated Distributor’s, did not have any workers’ compensation insurance policies at the time. On October 22, the deceased workers’ wife filed a lawsuit against Consolidated Distributors, Inc. as well as RecycleTech Corp. His employer is being sued for company negligence and RecycleTech for lack of warning and proper using instructions. The machine also did not adequate guarding to keep workers safe during operation and can therefore be declared defective.

In the petition it states that a safety guard is a necessary accessory that does not cost that much money and it could have been afforded by the company. The grounds for compensation stand that RecycleTech Corp knew of the dangers of the XT200 machine but they put it out on the market anyways. Lifeguard Dies in Texas Schlitterbahn Waterpark

At a waterpark in Galveston, Texas, a lifeguard recently died in the wave generator room. The waterpark is owned by Schlitterbahn Beach Resort Management LLC who is now being sued along with Enterprize Management Inc. for violating six different safety codes. The Occupational Safety and Health Administration, or OHSA, started probing into this case after two waterpark employees, a maintenance worker and the lifeguard, entered into the room where the wave pool generator is. While the two employees were in there, the machine happened to start up, causing the two individuals to be pinned between the wave machine and a gate. The waterpark obviously failed to properly train their employees so that they would be prepared and protected in the presence of dangerous energy source machines.

After OHSA heard wind of what happened, they were outraged at the blatant negligence that Schlitterbahn displayed by putting their employees at such risk. As the employer, Schlitterbahn is responsible for training the members of their staff and for making their work environment as safe as possible. This means that they should reasonably know of any danger hazards or safety violations on the premises and should correct them so that no workers or guests are at risk of injury.

Since Enterprize and Schlitterbahn failed to comply with several standard safety regulations, they have been cited by OHSA and a lawsuit against them is now pending. Some of the specific safety code violations that they committed include:

  • Failing to install railings on the sides of open stairways and platforms in the waterpark

Drunk Driver Who Caused Fatal Accident Sentenced to 38 Years in Prison

When drivers get behind the wheel while intoxicated, the outcome can be deadly. This was the case in a recent case that stemmed from a drunk driving accident that took the lives of two people and seriously injured a third person in June 2012 in Montgomery County, Texas. On Aug. 2, the 24-year-old woman who was charged with two counts of intoxication manslaughter and one count of intoxication assault was sentenced in to 38 years in prison, according to an article in The Courier. The driver had been found to be driving with a blood alcohol level that was more than three times the legal limit.

The woman was initially fighting her charges in trial, but after three days of testimony being presented to the jury, she pleaded guilty to her charges. According to reporting from The Courier and Fox 26, the woman was caught on surveillance camera consuming 17 shots and four beers at a bar in Montgomery County over a period of five hours before getting in her F-150 pickup truck and driving the wrong way on Interstate 45. Her truck then crashed head-on into a car that was carrying three people.

As a result of the crash, the car’s 19-year-old driver and its 18-year-old passenger died at the scene of the accident. The other passenger, who is in his early 20s, survived but suffered from serious injuries that required multiple surgeries. Because of the drunk driving accident, the survivor suffered from brain trauma, a fractured spine and severe survivor’s guilt. Furthermore, some of his teeth were knocked out and bone was ripped out from his upper mouth.

According to the news stories, the driver was found to have a blood alcohol concentration of 0.30, which is more than three times the legal limit of 0.08. Furthermore, a glass drug pipe was found in her truck and it was later discovered that she had marijuana in her system at the time of the deadly car accident.

In addition to the intoxicated driver receiving a prison sentence, the Montgomery County bar where the drinks were consumed was also held accountable. The bar has been ordered to pay a $1 million settlement to the surviving accident victim and to the family members of the two deceased victims, according to Fox 26.

The publication noted that while incidents is being investigated by experts, the park is not required to provide a report to the state concerning what caused the woman to fall to her death. Currently, the agencies that oversee inspection regulations for amusement park rides and the stringency of these regulations vary state-to-state.

One study recently showed that more than 4,000 children are injured due to amusement park rides each year, according to a CBS Cleveland article. The study was conducted by researchers at the Center for Injury Research and Policy at Nationwide Children’s Hospital in Columbus, Ohio. Of the injuries examined in the study, 29% were soft tissue injuries, 21% were strains and sprains, 20% were cuts and 10% were broken bones. 2 Bus Company Men Indicted for 2008 Deadly Houston Bus Accident

Back on August 8th of 2008, there was a fatal bus crash that took the lives of 17 passengers on board. The bus company, Angel Tours, was not formally indicted until May 30th of this year. The case was unsealed on Wednesday May 29th and then on Thursday the federal court formally indicted the bus company owner and one of his employees. The bus owner, De La Torre, was formally charged with one count of conspiracy, four counts of making false statements, and finally one count of operating commercial vehicles after being put out of service. Angel Tours was placed out of service because they received a poor safety rating and several safety violations from the FMCSA. One of the Angel Tours employees, Carlos Ortuno, was always arrested and charged with one count of conspiracy as well as two counts of making false statements. The two men that were indicted were both Houston residents.

Angel Tours was in business as a commercial motor vehicle company from 1994 to August of 2008 when the fatal bus accident happened. On August 8th, their bus happened to be carrying 55 Houston passengers and they were traveling to Carthage, MO. The bus never made it to its destination because it crashed on Highway 75, not far from Sherman. Seventeen passengers died as a result of the crash and 38 others sustained serious injuries. After an investigation was conducted by the FBI and the Department of Transportation, the federal court found out was that the FMSCA has put Angel Tours out of business weeks prior to the fatal accident because they failed their safety inspection. De La Torre still had his commercial buses running after the FMSCA told them to stop all transportation on June 23, 2008. Every count of conspiracy and false statements carries a five year prison sentence and a fine up to $250,000 if the two men are to be convicted. De La Torre could face further punishment including an additional year of imprisonment and a $25,000 fine for operating the business after he was put out of service.

Fertilizer Plant Explodes in Waco, Texas

On Wednesday April 17 around 7:50 pm, there was a massive explosion at the West Fertilizer Plant approximately 18 miles north of small town Waco, Texas. According to the U.S. Census Bureau, this little community is home to roughly 2,800 people. The fertilizer pant explosion sent an enormous fireball and a massive mushroom cloud of smoke up into the sky alerting emergency responders from all surrounding areas. The explosion blast was registered at a magnitude of 2.1 by the U.S. Geological Survey, which is similar to that of a minor earthquake. Dozens of emergency vehicles showed up and responders began treating injury victims on a nearby football while the fire was still smoldering.

So far there have been roughly 200 people injured in the blast who are seeking medical attention at the Hillcrest Hospital in Waco, along with two other nearby hospitals. Injury victims are streaming in with severe lacerations, orthopedic injuries, head trauma, broken bones, minor burns and respiratory problems. There were six helicopters at the scene that were assisting with medical transfers for the seriously injured. All others were either transported by ambulance or other vehicles. Tragically there have also been 12 bodies recovered and pulled out of the plant explosion. As of Friday they were still unsure if any who were killed were first responders. Many off duty fireman from the surrounding fire departments responded to help with the fire.

Shortly after the blast state troopers were making their way into the scene wearing gas masks for extra precaution. The blast had also set a nearby nursing home and apartment complex up in flames and about 75 homes were damaged. Some residences that were not too far from the scene were completely flattened and others had their windows blown out from the pressure of the explosion. Residents who live near the blast have all been asked to evacuate for the time being because they are worried that another tank might explode and the danger may not be over. The major concern at this point is the danger of anhydrous ammonia. Information from the Center for Disease Control and Prevention tell us that this is a powerful gas that is comprised of asphyxiating fumes and it is commonly used in fertilizer. When humans are exposed to anhydrous ammonia however, it could lead to serious health implications.

With part of the community completely gone, the people of Waco, TX are trying to piece everything back together. There was an investigation team sent by the U.S. Chemical Safety Board headed to the scene to look further into the cause of the explosion.
