Happy Easter How to Keep Your Family Safe this Easter Holiday

How to Keep Your Family Safe This Easter Holiday

Easter is supposed to be a fun holiday to spend time with friends and family. Many times, the excitement of the season coupled with adverse conditions results in injuries that turn this festive occasion into something unpleasant. Here are some ways you can avoid the most common holiday injuries so that everyone in your family can enjoy this Easter the way they should.

Preventing Slips and Falls

Slips and falls are by and large the biggest cause of injury among children. Kids are more likely to slip and fall whenever it’s wet outside, as is often the case during the Easter season. To prevent them from falling, never allow them to play on playground equipment or jump on trampolines when they are wet. Ensure your kids wear the proper footwear when playing outside. Those dressy shoes might be perfect for church, but they’re not necessarily ideal for playing in afterwards.

Children can fall indoors as well. As such, have them take off wet shoes whenever they come inside so that floors won’t get soaked, thereby creating conditions that are ideal for falling.

Bicycle and Pedestrian Accidents

You may allow your children to play outside a little later in the evening now that the days are getting longer. If so, you need to ensure that they don’t stay out too long if they are walking or riding bicycles. Children are more likely to get hit by a car at dusk, so be sure they are home well before the sun starts going down. If they must stay out later, be sure they are wearing reflective clothing and carrying a flashlight in order to help them stay safe.

Automobile Accidents

Beginning on Good Friday, a number of people will hit the roads while traveling to visit friends or family members. Whenever there is an increased amount of traffic on the roads, the number of automobile accidents also increases. Remember this whenever you are traveling, so that you can plan enough time to get to your destination safely. If possible, avoid driving during peak travel hours. You’ll not only avoid congestion, but decrease your risk of being involved in an accident as well.

By following these safety tips, you can reduce the odds that your children will be involved in an accident this Easter. That way, you can spend time making great memories rather than nursing a wound that might easily have been prevented if the right precautions were taken.

Professional Legal Representation

Even with good planning, it’s possible for somebody to get injured due to negligence from a third party. If you or a loved one have been injured, then it’s important that you speak with a professional to review your options. Can I Sue If My Child Was Attacked by a Dog

Can I Sue If My Child Was Attacked by a Dog?

Children are naturally attracted to animals, so it’s not unusual for them to want to pet stray dogs. Unlike adults, kids may not notice the warning signs that an animal is becoming agitated, and may be bitten as a result. When this happens, a common question parents ask is whether or not they can recover damages from the canine’s owner.

Local Laws and Ordinances

When determining who is at fault in a dog bite case, it is important to consider local laws and ordinances. Different jurisdictions have their own statutes in place regarding leash laws, dangerous breeds, or dogs running freely. The first step toward finding out who is responsible should be a review of these laws in order to know if there was a violation of them.

Local laws also differ as to when an owner can be held responsible. In some areas, an owner is not responsible unless he or she could reasonably have anticipated the pet biting. In other locations, dog owners are responsible regardless of the circumstances. A personal injury attorney can be a valuable source of information when it comes to evaluating local laws in order to determine liability.

Contacting Authorities

In some cases, children may be bitten by an animal that is roaming at large. When this happens, the proper authorities should be contacted so that they can attempt to locate the dog and its owner. Doing so is beneficial, even when the owner cannot be located, because it might prevent other children from also being bitten.

There’s another advantage to contacting the authorities, in that a record of the dog bite exists. This could prove very helpful in the event a child must undergo rabies treatment or suffers a serious infection.

If a ban on dangerous dogs exists, the owner of such an animal could face criminal sanctions. Although criminal charges would be brought separately, the fact that an individual was charged could go a long way toward proving liability for damages in civil court as well.

Actions after An Attack

After a dog bite occurs, it is important to seek medical attention, even if the bite seems relatively minor. Dog bites can easily become infected, so it is better to be safe rather than sorry. It’s also important to gather as much information as possible about the incident to include location, description of the dog, and the names and contact information of any witnesses. This information could prove useful in the event a dog bite case requires legal action.

Getting Legal Consultation

Dog bite cases are very difficult to win without a legal export fighting on your side. However, with a good personal injury attorney, you can win your case and receive justice. Schedule a free case evaluation today by calling 713-222-1222.

My Child Was Injured in a School Bus Do I Have a Case

My Child Was Injured in a School Bus: Do I Have a Case?

Riding a school bus is a part of childhood that is unavoidable for a number of kids. When parents allow their children to get on a school bus, the last thing they think about is that they might be involved in an accident. School bus accidents do occur regularly, and can be just as devastating as any other type of automobile accident when they do happen.

Negligent Hiring Practices

School systems have a duty to the families they serve to provide them with drivers who are capable of transporting children safely. This means that they must carefully screen candidates to ensure they have a safe driving record and can pass a physical exam. The truth is that school systems across the country often face significant shortages when it comes to bus drivers, and may overlook some of the criteria when hiring them in an effort to fill their shortages. When one of these drivers later has an accident, the school system could then be liable due to negligent hiring practices.

Faulty Equipment

The manufacturers of school buses can also find themselves in hot water whenever an accident is due to a faulty vehicle design. Some of the design issues that could create problems with the way a school bus operates include:

  • steering
  • body design
  • tires
  • braking system

When there are manufacturer defects, a school bus may be difficult to control or stop, or might even roll over when turning sharp corners or heading up an embankment. A poor interior design could also lead to uneven weight distribution within the bus, which would also make it difficult for the driver to control it.

Reacting to an Accident

School bus accidents tend to receive a great deal of publicity from the news media. There may also be several children who are injured in a particular accident, which means a school system may be inundated with claims and/or requests for information from the public. Their response to this is normally to “shut down” and refuse to make any statements in the hopes that the negative publicity they are receiving will somehow go away.

By attempting to avoid negative publicity, those responsible sometimes make it very difficult for parents of injured children to recover from their damages due to a lack of information. In these instances, there may be no other option than to file a lawsuit in order to obtain the relief they have coming to them.

Fast Food Playhouse Disasters Common Child Injuries

Fast Food Playhouse Disasters: Common Child Injuries

In an effort to attract families with children, a number of fast-food establishments build “playhouses” inside their restaurants. As a result, parents often bring their kids to these restaurants to enjoy a meal and then burn off some pent-up energy. What is intended to be a good time sometimes ends in the unthinkable whenever a child is injured while playing in one of these playhouses or playgrounds.

Number One Cause of Falls

The leading cause of injuries in playhouses is falling. Playhouse equipment and playground equipment is normally built in such a way that children are naturally encouraged to climb on them, which could lead to falls from equipment that is slippery or not sturdy. To make matters worse, the surface beneath these structures sometimes does not contain adequate padding to cushion a fall, which means that children can suffer:

  • broken bones
  • head injuries
  • concussions
  • serious sprains

Design Problems

Chain establishments tend to have the same type of equipment installed in many of their locations. Injuries sometimes happen because of a defective design, in which case there is the potential for children in multiple locations to become injured. When corporations become aware of a problem at one location, they should take action to rectify this problem in all their stores; however, this doesn’t always happen. Replacing or repairing poorly designed playhouse equipment can cost thousands or even millions of dollars, so corporate executives might “overlook” the defects in order to increase their profit margins.

Determining Negligence

Parents of children who have been injured in a playhouse can do a few things in order to determine if an establishment is liable for negligence. Some things to consider when doing so are:

  • Condition of the playhouse or playground equipment
  • Nails
  • Splinters
  • Rust
  • Whether or not the appropriate warning signs were in place
  • Presence of cushioning underneath climbing obstacles
  • Whether or not there have been product recalls by the manufacturer
  • Occurrence of similar injuries at another corporate location where the same type of equipment is installed

Just because there is sufficient evidence to show negligence does not mean that parents of injured children will be able to recover their damages. Fast food restaurant chains often hire teams of lawyers to defend them against even minor claims. In fact, they will sometimes spend more on defending a claim than what it would cost to pay it in order to deter other people from filing similar lawsuits. As a result of these tactics, moms and dads may need to develop their own legal strategy to help deal with the situation.

Hire a Professional Injury Attorney

The thought of taking legal action against a large corporation is kind of terrifying. But if your child has been injured, then you own it to your child and to the children of your community to take action. The best way to do so is to hire a legal professional who understands how the courts operate. Schedule your free case evaluation today by calling 713-222-1222.

What Is Floppy Baby Syndrome

What Is Floppy Baby Syndrome?

Technically known as hypotonia, Floppy Baby Syndrome is a condition that is characterized by unresponsiveness, extreme muscle weakness and a lack of muscle tone. Any one of a number of things can cause Floppy Baby Syndrome, including:

  • down’s syndrome
  • cerebral palsy
  • muscular dystrophy
  • septic shock, a condition caused by exposure to toxins
  • heart failure
  • hemorrhaging
  • spinal cord injuries

These are only a few of the causes of Floppy Baby Syndrome, as there are actually dozens of things that could cause this disorder.

What Are the Symptoms?

The signs of hypotonia usually manifest themselves during infancy, and may or may not be present at birth. A few of the signs that might be present include:

  • excessive drooling
  • inability to control the head (in children who are old enough to do so)
  • very loose limbs and flexible joints
  • feeble and weak crying
  • poor attention span for age
  • difficulty nursing
  • poor development

At the first sign of any of these symptoms, parents should consult with a physician so that further tests can be performed if necessary. This is especially true if the symptoms seem to come on rather suddenly, yet are not the result of an accident or injury.

How Is It Diagnosed?

Diagnosing Floppy Baby Syndrome can sometimes be difficult to do, since there are a number of things that can cause it. Doctors may sometimes prescribe CT scans, MRIs, biopsies of the muscles and nerves or genetic testing in order to make a diagnosis. These tests are done not only to determine whether or not a child has Floppy Baby Syndrome, but to determine the underlying cause of it as well.

Treatment and Causes

The exact treatment will depend upon the cause of this condition. Regardless of its cause, infants who suffer from Floppy Baby Syndrome will likely need extended medical care for some time; some will not even survive. Those who do could need to undergo multiple surgeries, complete physical therapy, or be required to take maintenance prescriptions in order to control their condition.

The conditions that cause Floppy Baby Syndrome are sometimes brought about as a result of medical negligence, with one of the most common ones being birth injuries. Doctors may also fail to make a diagnosis early on, which in turn could result of a worsening of the condition. When the underlying cause of this disorder is negligence, parents may be entitled to recover damages in a court of law.

ATV Injuries They Can Happen to You!

ATV Injuries: They Can Happen to You!

ATVs allow people to access remote areas they might not otherwise be able to get to with other modes of transportation. They are sometimes used by farmers and ranch hands to get to their fields and livestock quickly, and those in the logging industry frequently use them as well. Riding an ATV is often performed for recreation, with a number of parks providing trails especially for that purpose. Regardless of the reason for riding them, ATV accidents can happen.

Causes of Injuries

Defective equipment is one of the leading causes of ATV accidents. Vehicles that are poorly designed may roll over, flip on end or throw riders off of them. The same can be said for vehicles that are properly designed but poorly maintained. Those who provide them for others to use are responsible to ensure that they are maintained properly, regardless of whether they are being used for commercial or recreational purposes.

Injuries sometimes occur whenever the right safety equipment is not worn or fails to function properly. Riders should always wear helmets and avoid loose-fitting clothing that might get caught in certain parts of the vehicle and cause an injury or malfunction.

Riders should also receive safety briefings before departing, to include an update on current weather conditions. They should also be made aware of any trail hazards so that they can take the necessary precautions once they depart.

Common Types of Injuries

ATV injuries can range from moderate to severe, with some of the more common ones being:

  • broken bones
  • head trauma
  • crushing
  • severed limbs
  • paralysis
  • death

Time is usually of the essence in any injury, and the fact that many ATV accidents happen in remote areas often makes it challenging to obtain medical attention. As a result, many people wind up suffering more than they should because they are unable to receive help in a timely fashion. When cell phone coverage is sparse, it can be a good idea for riders to carry a radio with them so that they can signal for help should they be unable to make a phone call.

Performing an Investigation

The first priority in an all-terrain vehicle accident should be to seek medical attention. After that, an investigation into the cause of the accident should be performed so that future incidents can be avoided. If negligence is discovered during the course of an investigation, legal action might be necessary in order for the injured party to fully recover damages.

Get Legal Help Today

If you have been injured by an All-Terrain Vehicle, then you are probably making some tough decisions such as how you will pay for all of your medical bills and how to live your life after your injuries. One of the best decisions you can make is to hire a skilled personal injury attorney. You can schedule a free case evaluation today by calling 713-222-1222.
